License and Use of Recognition Badge.

Should the Client be "Officially Culturally Recognized," the Client is granted a limited, non-exclusive, non-transferable license to display the Official Recognition Badge for a period of twelve (12) months from the date of the award.

The Client agrees not to alter, photoshop, falsify, or otherwise misuse the Badge.

Any use of the Badge in a manner that misrepresents the Client's recognition status, or any unauthorized use, will result in the immediate revocation of the Client's recognition status and AWI profile. Furthermore, the Client agrees to pay the Company a penalty fee of $10,000 USD for such misuse as a reasonable estimate of the damages incurred to the Company's reputation and intellectual property.

Publicity, AWI Listing, and Marketing Rights.

A core component of the product for qualified Clients is public recognition. Client understands and agrees that this includes a featured profile on the Agency Workplaces Index (AWI) and inclusion in official press releases.

Opt-Out: Client may opt-out of all public recognition (including the AWI profile and press releases) by providing written notice to the Company during the onboarding period, no later than fourteen (14) days after the Effective Date. This decision to opt-out is final for the 12-month term.

Data Rights and Anonymity.

The Company guarantees that all individual employee survey responses are 100% confidential and anonymous. The Company will not share any non-anonymized or individually identifiable data with the Client.

In consideration for the products provided, the Client grants the Company a perpetual, worldwide, irrevocable, royalty-free license to use, copy, and display all anonymized and aggregated data collected from the survey for marketing, research, industry reports, and product improvement.
